Jeffrey Weiser, DDS. was the most popular dentist among bodybuilders for several years even though he never evaluated any patients. Yet he guaranteed to bring a big smile to the faces of his bodybuilding clientele.
Even though Weiser retired from the practice of dentistry in May 2001, he retained his DEA controlled substances registration enabling him to continue writing scripts for prescription medications. Weiser used his DEA license to write prescriptions for various anabolic steroids such as testosterone, nandrolone, oxandrolone and stanozolol; human growth hormone; and ancillary medications such as HCG, Clomid and Nolvadex from July 2001 through October 2004 for clients of his “personal fitness consulting business.”
Weiser advertised his services on various bodybuilding forums and found many customers who felt that they were legally obtaining anabolic steroids. After all, they received a prescription for the bodybuilding medications which they could take to their local pharmacy. There would be no legal risks with a prescription for steroids, would there?
Unfortunately, the prescriptions for steroids issued by Dr. Weiser were legally invalid prescriptions. Writing prescriptions for anabolic steroids and growth hormone were clearly outside the scope of the practice of dentistry. Dr. Weiser was making $16,000 per month writing prescriptions at $50 per script per medication for hundreds of bodybuilders around the country. Selling prescriptions for controlled substances is illegal.
Furthermore, Dr. Weiser imported recombinant human growth hormone that he purchased from Anhui Anke Biotechnology Company in China. This compounded the legal problems of Dr. Weiser since the HGH was not FDA-approved and labelled in Chinese rendering the HGH misbranded.
Dr. Jeffrey Weiser’s fitness consulting business came to an end in October 2004 when the FDA Office of Criminal Investigations executed a search warrant on his Florida home in October 2004. Dr. Weiser should have known that his steroid business was coming to an end after Paypal terminated his account in spring 2003 for illegally distributing drugs OR when U.S. Customs seized a shipment of AnkeBio HGH in November 2003 OR when Horizon Blue Cross and Blue Shield notified him that “prescribing of anabolic steroids and human growth hormone were outside the scope of the practice of dentistry” in September 2004.
What does the arrest of Dr. Jeffrey Weiser mean for all of the bodybuilders who obtained prescriptions from him? Do they face legal ramifications? In most cases, probably not; there is no precedent for individuals being prosecuted for steroid crimes when they possessed prescriptions, valid or invalid, for the steroids in question.
But prosecutors have seized all records of Dr. Weiser’s clientele and Dr. Weiser has provided “substantial assistance in the investigation or prosecution of others who have committed offenses” and promises continued cooperation as a condition of his plea agreement.
It appears that Dr. Weiser’s cooperation has implicated several Trenton Police Department who allegedly purchased prescriptions for anabolic steroids from him. It does not appear that the officers will face legal trouble from obtaining invalid prescriptions for steroids and HGH from Dr. Weiser. Instead, the police investigation is apparently focusing on insurance fraud since they used their “city heath plan cards” to pay for HGH at Trenton area pharmacies.
Dr. Weiser was sentenced to 4 years probation with 6-months home confinement and a $10,000 fine in late 2007 after pleading guilty in May 2005. He recently finished the home confinement penalty of his sentence.
