Probation

So I'm on probation for an alcohol related offense and today I got an ETG test, which is a test to detect the metabolite of ethyl alcohol in your urine. I pined GP test E about 48 hours ago. Does anyone know how fucked I am?

Alright thanks I checked another on of my ugl vials and it said benzyl alcohol at 2% but I read the test could show a false positive even from inhaling topical (isopropyl) alcohol.. Also GP test is thin as hell so I wasn't sure about the difference in alcohol concentration

gotta remember too....even if it somehow "could" detect it. It is only 2% of a ml.
Its not like you downed a shot 30ml of 40% alcohol.

Some foods even contain small quantities of alcohol. eg artificial vanilla extract

I would think it would have to be over a certain threshold to even draw their attention.
do not sweat it!

A DUI that resulted in serious injury or death you'd have to get tested, as in one case a friend of mine drove drunk some years back and severely injured a pedestrian. He served some time in prison and had to get tested randomly while on probation.

I had a buddy hit and kill a pedestrian in hobbs, new mexico. He did some prison time and continued to drink and drive after that. I got a dui a little over two years ago. I was even outside of my truck but I guess if you have your keys on you and within 25ft of your car you can still get one. God bless fucked up california.

Bet cop thought you were going to get into your truck, judging by the keys in your possession. Yea the law is rather fucked out in Cali so bummer you got hit with a DUI when you were not even in your truck but with merely the keys to it on you.

Sucks about your buddy...seems those are the ones that are the worst. You should have beaten some sense into his addled head before he killed someone.

I stopped hanging out with that guy because he was too crazy. I tried to fight my dui but couldnt afford a legit lawyer at the time so they dropped my bac from .22 to .19 and I accepted to avoid further penalties. The cop was just being a dick. They get a bonus for every dui they hand out on the weekend. I have to look out of state for work because of it.

Ouch that sucks, and to me cops that act like that aren't even worth their badge IMO. The whole system is totally FUBAR.

I talked shit to the cop for sure, my defender was upset with all I said lol. In SoCal the cop situation in SNAFU lol
When you are a bit buzzed yes you might have said things you'd regret later. I've done some dangerous shit myself when I was drunker than a skunk like crossing a highway at night, nearly getting hit as I was crossing.

I was already arrested in the back of the car so if I hurt his feelings Im glad thats the least I could of done. Now I try and steer clear of the booze, evidently my idea of a good time doesnt coincide with other peoples idea of a good time.

Another example of how fucked up the justice system is in the United States. The justice system shits on anyone who cannot afford private counsel. It's absurd that someone should even be charged, let alone indicted, for a DUI charge when there is no clear evidence that the accused was ever actually driving. Did the officer even have reasonable suspicion to stop and detain you? Any policing that encourages officers to make arrests for personal financial gains, will always lead to bad policing.

Unless you admitted to the officer that you had already been driving under the influence, I don't see how he even justified having probable cause to make the arrest when you weren't even in the vehicle :(. Unless you confessed to operating the vehicle or intending to operate the vehicle while under the influence, there is no evidence that you had even committed or even intended to commit a crime. Even if you confessed to operating the vehicle earlier that doesn't mean you were over the limit when you were actually driving. Unless the officer lied in the investigative narrative, I don't see how the case ever saw the light of day. It's hard to prove that someone even had intent to drive under the influence when they weren't actually in the vehicle and they never made a confession. Possessing keys to a vehicle and being within a certain distance of the vehicle is a fucked up way to justify making DUI arrests.

But I've seen stranger things, like someone being charged with possession with intent even though they aren't in possession of any controlled substance and there are no controlled substances in the residence, and no material evidence to support that there ever were drugs on the person or in the residence.

I didnt know it at the time but I was down the street at a gas station near the police shooting range. I said I was waiting for my wife to pick me up and had been drinking in the parking lot, I even had open containers in the back of my truck, impossible to put there while driving. He told me there was surveillance and he had an eye witness and finally said it was my word against his. Surprisingly when the surveillance was requested on several different occasions it was found that it didnt exist. Bottom line was lack of money on my part and I couldnt get a conviction of a .22 bac, pretty serious in socal. It is a very fucked up system that relies on bullying tactics to create revenue.

I got a DUI last year. My girl's car was parked in a parking lot of a bar, convertible bmw, and I had left the top down while we were inside. We both had a bit much to drink so we called über. I got in the car to put the top up and another car in the parking lot backed into our car leaving their spot. When the cops showed up, they took me to jail for DUI because I was "in control of my vehicle while intoxicated." Now I have an interlocking device in my car. In all fairness, I guess it's punishment for all the times I drove drunk and never got caught but it sucks it happened when I was trying to be responsible.

So many fucked up stories. I don't think that all cops are bad but I think more are than not. Times are changing though thanks to cameras on cell phones. Anytime I see a cop I get my phone ready.

couple years ago on the east coast of canada...

Guy was in the bar and had too much to drink. Did the right thing and called a cab.
Just then the bar kicked everyone out as they were closing. He waited outside but it was below freezing, so he got into his car to wait.
Cop saw him in his car...tested him and charged him with DUI because he was inside his car with the keys in the ignition (had his car on for the heater)

It went before a judge and finally some sense prevailed.
Driver brought out a rep from the cab company which had the time he called logged.
Brought weather statements showing it was fucking freezing out.
Had ticket showing what time he was charged
brought bar owners statement that he called cab from inside but was told to wait outside

Judge acknowledged that police were wrong to charge him as there were extenuating circumstances.

So there is the 1% time that the system worked sort of
