A new face for steroids case

William Fanciullo, 57, whose practice is based in Albany, was picked to handle the high-profile case after the district attorneys of Saratoga, Schenectady, Rensselaer, Columbia, Greene and Schoharie counties rejected the opportunity.

"I'm going to look at the matter. I'm going to make an independent determination," Fanciullo told the Times Union on Tuesday. "It's my understanding the materials are voluminous."

Albany County Judge Stephen Herrick appointed Fanciullo on Monday -- one week after Herrick dismissed the case for the second time in three years. On Nov. 15, Herrick disqualified Albany County District Attorney David Soares' office from prosecuting the case citing a conflict of interest, but allowed Saratoga County District Attorney James Murphy, who Herrick named special prosecutor, to present it to a grand jury.

Murphy, in turn, rejected the appointment.

Murphy noted county law allows judges to appoint district attorneys in adjoining counties as special prosecutors when local prosecutors are disqualified. But he wrote it is "provided such district attorney agrees to accept appointment by such criminal court."

Murphy sent the letter to Soares and Franklin County District Attorney Derek Champagne, who leads the state's district attorneys association. Herrick wrote that prosecutors in counties adjacent to Albany all declined the case.
