Court allows UPS employee search evidence

So what do you suggest
Using your real name?

Yep

Yes bc if you're gonna get got, it'll happen regardless of whatever name you use. Using your real name, or a name associated with an address, at the very least will allow you to recover money should be circumstance arise that you need to.

In addition, should there be something challenge-able in the case, as there was in this case, using your real name allows you to challenge the evidence.

If you are accepting the package I don't think it even matters.
You're right

Not to sound like a broker record but
at least with a fake name
a sharp attorney could argue in court that you were too drowsy/drunk/stoned/fapped to notice it was a misaddressed package in someone else name thus not yours

:) I would pay to see this argument done well.....

Im guessing you didnt actually read the article (hows marvel doing here anyways?)
And to answer your question if a package comes to your house for John Hancock with illegal goods they can say theyre not searching boxcars stuff. Theyre searching for John Hancocks stuff. He has the same address. And if they come across some illegal goods owned by boxcar...well sucks to be you.
You can't deny the search. Theyre not searching you. Theyre searching John Hancock.

No I didn't, you caught me lol.

Marvel and I have since gone our ways. Marvel decided after almost 4 years it was time to retire.

True. And when / if it goes to court it could blow up in their faces. Same as police pulling you over and finding weed in the car. If they falsly pull you over anything they find after is inadmissable.
But also remember that the majority of Americans who have nothing to hide wont raise a huge fuss about being searched.
they would never pull you over without "reason". it could be not signaling, or rolling a stop sign (which everyone does). and law enforcement, in my state at least, anything within arms reach of suspect is admissible without search warrant. it allows them to clear the immediate area for there safety. and one can argue just about everything is within arms reach in a car.

Not all judges or juries will fall for that clever ruse though even if well argued by a sharp lawyer. By accepting that package (and signing for it on your free will) you are saying it's yours...no matter what name it's under, am I right?

To me it sounds like because the fake name was titled an "alias" it's not protected under the Amendment. If they can convince the judge it's a pseudonym, he would be protected under the amendment. However, it will be pretty tough to do that now. Unless the Defense Attorney covers the Judges New Years Eve annual party for him. Power of Attorney is everything in court.
