[SIZE=-1]I am often asked why I have been supportive of Ms. Thanou in my reporting of her infamous case from 2004, through to her current travails with the IOC. Let me be clear that I am not supportive of any one athlete; what I am supportive of is the rule of law, which I have also espoused in writings on the Dwain Chambers case. More.[/SIZE]

[SIZE=-1]The only penalty to have been imposed on Ms. Thanou in the past decade is a two-year suspension for missing three drugs tests, in the year prior to the Athens Olympics, the third on August 12, 2004, the eve of those Games. The official verdict from an out of court settlement from 2006 with the IAAF was that Ms. Thanou did not evade or refuse to submit to that third test. This was consistent with the Greek federations ruling. If Ms. Thanou did not evade any test, then the reported motorbike accident on the night of August 12, 2004 is irrelevant. [/SIZE]

[SIZE=-1]The IOCs actions this past year -- delaying the upgrade of Ms. Thanou to the 100m gold medal position from Sydney and her being kept out of Beijing -- seem to have relied more on the applause meter rather then sound legal principles and policies that are applied evenly to each and every athlete. It is those actions that will be the basis of a legal challenge that we have recently reported on.[/SIZE]
