When i split with my wife i agreed verbally to take two of our credit cards and she took one. Well I have recently been served papers b/c she hasnt been paying the damn credit card payments. I guess they havent been paid for like a year and are taking me and her to court. What are my options?

Just make sure it doesn't go to collections bro, cause you get another 5 years bad luck everytime you do get sent to collections. You should make an arrangement with the credit card agency until it is worked out and it's easy as 123 to cancel the card. Then she'll feel stupid next time she tries to use it. Must cancel card though.

Shitty thing is not much consumer protection for a person who admits they gave carte blanche sp? to someone to use their card. But here in CA she would be liable for debt since it was accrued whilst still married I believe even though separated. Dicorce sucks bro! Good Luck!

If it's in the court papers that she 'owns' those credit cards, you can write to the judge presiding, and he can take action against her for breaking the divorce contract.

If you do nothing, they will take the money from you.

Sometimes, depending on the company and the person you talk to, they will read the court decision, and then go after your wife only (this happened to me).

Worst case, they won't care because some bean counter will be in charge who doesn't care.

BUT, you can go after your ex, later, if it was in the papers that she was to pay also. But if it's not spelled out, you are screwed.

Last ditch effort you could take her to court if you have a witness, or evidence that you made the agreement. Then the court would make her pay you back.

thick, buddy, my first wife and i HAD THE SAME AGREEMENT well she did not pay eaither, LOl so I got fucked and had to pay but we both did, tell her she is a big bitch and suck it up and take the loose, check your credit report just to make sure if it is not on there tell her she can go fuck off and she pay it, lots of times if a spouse gets a credit card they use only on SSN# social security card, and it is possible yours might not of been added just the name, and the credit card cant prove you had it, got the idea bro, hope this helps, if you want me to take care of your EX let me know bro, I will give her thte big speedobob

well you know court cost a bunch, get the statement and ask her nicely if she dont mind if she pays 3/4 and you 1/4 if not say half if she says no, then try a lawyer oppion. but being nice at first might just get something out of her in the meantime your credit is reflecting on the matter, what I did was have all the credit card places we had send to me the application just to make sure I did not fill it out and my name was not on it, then it had to be erased off credit report, credit is hard to get and easy to fuck up, good luck make sure you get all ammo before going to court, application, dates, times, etc, you know the deal bro

I went through a similar thing. This was my loop hole. The Fair Debt Collection Act states that both parties that signed the contract are responsible. In case of divorce the parties are both responsible for the debt accrued up until the day the divorce was served. If she racked up bills after that it is on her. You should find out what the ending balance was when you filed on her.

If you aren't divorced yet, get it in writing. She has to pay half of all debts and split half of all property (assuming your in a no fault state).

I took on $5000 worth of debt though, because my wife was going to force me to sell the house for half the equity it had gained over the years.

She was a hair splitter like that, but that's how divorces get.
