Illegal seizure...Should I sue???

I was in a prior situation where police had a knock and announce search warrant to take only a few items listed...Instead they ended up taking my laptop which they asked me and I certainly advised them, NO they can't take it. Well they just ended up taking it anyway and a week later got a warrant to "take it"....Me being in school at the time I wanted to be able to work on things since I had a few online classes...Due to me not having a laptop anymore I had dropped out of school for the semester because I had important time sensitive documents on there that had to be complete/transferred and without these it would make me incapable of passing the classes. All the heat is off now...given this is months ago...and I'm just now receiving my laptop back. I had told them they wouldn't find anything...and weird, they didn't. Obviously from their shoes it would've been ok to not believe me and still get a warrant and THEN take it...I was wondering if you guys think I had a chance in a lawsuit against the police department? I would be suing for financial damages caused by an illegal seizure at the time...I have a witness that can confirm all of this as well. Now I'm stuck paying last semesters bill... What do you guys think???

-Note- When I had to file a return of belongings, I went to court and the judge was PISSED at the prosecutor for how this occurred and approved the return of belongings.

Obviously you need to speak to a attorney.
I have an attorney, I asked him today about it, but he wasn’t in the office..he’s the best in our area, but I’m just not sure what he’ll say regarding the topic. Yeah still dealing with this shit man :confused: it’s crazy how terrible things can get even when you’re legitimately innocent..

Well on something like this I would only use an attorney that collects when he wins. Other than that don't spend a dime. Good luck and hope you learned a lesson. Like I think it was James brown use to do. Took a picture with every chic smiling before he banged them as proof they weren't forced lol
 
if the laptop was NOT specifically listed in the warrant application then they cannot take it. Taking that laptop is wrong and you should have asked your attorney to petition the court sooner to return that laptop as it was taken without a warrant.

As to the question if can you sue for the loss you had to take because of the laptop being seized, you should take this up with your attorney and he can advise you.
 
Only thing ive learned from the crooked ass judicial system is we are all guilty until proven innocent....Fuck em all. Now with that being said, watch em come an throw me in the slammer for the bad Karma i have jus created for myslef bahahahaha
 
I already paid him so that’s kind of an issue but I honestly think he’s good for it, my family has worked with them in the past and had good results-it is a group of lawyers with decades of experience- not to mention so many reviews and people had recommend him when I had already had him. So I hope I don’t have to worry about having a shitty lawyer..he’s been pretty good so far. @HIGHRISK

No I totally agree with you on that...I use to respect police officers soooo much but after being on the receiving end and seeing how corrupt they can actually be I’ve lost a lot of faith in our justice system. @Skull

If nothing at all just be happy your not a registered sex offender or locked up.
 
unfortunately with these types of things, it’s a losing battle.

you could absolutely try to sue the LE but courts take time and money. unless you have deep pockets and a very good lawyer it’ll most likely get dismissed.
 
if you’ve lost your hope in LE just wait until you try to sue them and go through the court system.

i’m currently in a legal battle and wow, what a learning experience. A very messed up system, all bullshit protocols, formalities, and restrictions. All time consuming and costly. Not worth it IMO unless your trying to go after real money

Look, honestly, this thread is pointless. Wait until the attorney calls back and listen to him (yes him, no woman lawyers). Getting law advice in here would be like getting financial advice from a kid on a playground.

No idk just wanted your guys take on it, wasn't going to do anything set in stone you guys suggested, but why not get the opinion of several people and a qualified lawyer vs just the lawyer..A lot of people on meso have been through some crazy shit so I figured I could expect some

Don't know how big your town/city is(don't need to know). I'd get an out of town lawyer. Shit ends up sketchy when mother fuckers play golf together.

Anyway @Robfromga case was dismissed...I’m still stuck with the fucking lawyer bill though which is such bs. They realized what she was saying didn’t match up with our conversations via text etc...BEFORE they realized all this they arrested me and put me through the rings though and of course I had to fuckin jump through them...so not only am I stuck with the lawyer payment but also the god damn dismissed case on my file...(dismissed cases can’t be expunged here)

You need to go after her with a civil suit. You can claim mental anguish, along character damage
 
Anything done to cause financial loss or damages is grounds for a lawsuit, police or civilian. With that being said, it is extremely hard to win a lawsuit against a police department, as most know, the police and court, are two of the same. If they don’t change the date of the warrant for the laptop, you have a case, but getting a judge to rule in your favor, unfortunately is slim. You could have all the proof in the world that these officers acted unlawfully and because of their actions, you suffered financially and emotionally, but the judge will still rule the officers actions were justifiable. There is one way and one way only to win a case against a police department, first you have got to have a case and evidence to prove it, second and most importantly you have got to get an attorney that is in the business for making a name for him self, and isn’t scared of what kind of reputation he will have for going to war with a police department. Trust me they are few and far between, but if you do have a legitimate case and attorney, it can be done.
