The physician checked a box on a form and, soon after, the DMV revoked Emerich's driver's license. PA requires doctors to report patients with alcohol or drug habits that might impair their driving. If they don't, and there's an accident, the doctor can be liable. Emerich, who weighs 250lbs, says he never drinks and drives and notes that his last traffic violation was a DUI 23 years ago."

Now ain't that bunch of shit! I run around naked in my house and sometimes I stick vegetables in my dog's ass. Maybe I should be banned from going outside, having a dog and posessing vegetables because of what MIGHT happen outside of my own home. (by the way, I don't have a dog and I never purchase vegetables. Dey be da debil! I do, however, run around naked a lot ;))
 
This is a very touchy subject and one I'm quite familiar with. AS I've stated before, I almost went to med school. I have several very good friends in med school right now....most of them are 3rd years.

My friend Joe has confided in me about similar situations he has encountered as a med student. He has told me that in med school they pound it in your head to report ANYTHING out of the ordinary so to protect yourself and your practice. With malpractice insurance on the rise and doctors being ridiculed for every little move they make, they are definitely on edge when it comes to situations like this. To a certain point, I can sympathize with the docs as I hear about these things from the other side (my friends in med school).

What I think is really sad is that nowadays in certain med schools they have classes on how to protect yourself from frivelous lawsuits.

One case in particular that my buddy Joe talks about happened a few months ago when he was doing his family practice rotation. A couple (according to my friend they were not the model parents to begin with...based on the files he had) brought their little baby in that had been injured. Well as a med student, Joe's job was to take the history, make some diagnoses, and then turn his notes over to the doc on call to handle the actual treatment. Joe told me that the baby had some red marks and some bruises on it's arms or legs...or something like that. In Joe's opinion (and this is where the problem lies....docs are asked to make a decision on limited information after talking with a patient for 15 minutes. This leaves tons of room for error), the babies injuries were not consistent with what the parents said happened.

Immediately JOe thought about child abuse...but knowing how serious of a charge that is (in my state, the doctor is required by law to call children services on the spot and report the findings immediately. The child is put into protective custody automatically upon a physician's report), Joe was afraid to say anthing to the doc on call.

Joe decided to NOT say anything to the doctor because he did not want the doctor to be biased when he examined the baby. He wanted the doctor to do his own examination and make his own conclusions.

In the end, the doc did not feel it was abuse and no calls to children services were made.

But you can see the dilemma here: if Joe was wrong and it was abuse and the child ended up dead....Joe could have been sued and disbarred for not reporting it. If Joe did call children services and he was wrong..he gets sued as well.

I'm split on this one.
 
hmmmm, you certainly took an interesting perspective on this. Hell, I don't give a fuck if the doctor told them the dude drinks. He was mandated by law, so it's not his "fault". What I'm angered by is the gov't's taking the dude's license on a motherfucking whim! Sorry, potential to cause a crime is not a crime.

That I agree with. I misunderstood you Grizz. I thought you were upset that the doctor reported his drinking habit....my fault.

IMO, that dude has a massive lawsuit on his hands against his state.
 
It is a pretty sad state of affairs when they offer "How to protect your ass 101" in med school. There is no excuse for the amount of lawsuits that get brought on doctors. They ain't fucking god, you know?

Sure, if he amputates your left foot instead of your right, which is the one that needs it, then, yes, I guess you should get a couple bucks. Not 4 billion like everyone wants, though. However, if you go to him with a cough, the sniffles and a pain in your lower back and he says, "I think you just have a cold" and it turns out to be cancer, tough shit! That's some pretty vague fucking symptons.

Conversely, if you came in with those symptoms and he ran tens of thousands of dollars of tests to ascertain that you really just had the common cold, the same asshole would sue for having to pay for "unneccessary" testing.

Fuck moochers!

What really pisses me off is that the most sued docs and the ones with the highest malpractice insurance premiums are OB/GYN's. If a kid is born with Down Syndrome, even though it is purely genetic and the doc has no control over it, the doc will almost certainly be sued. On average, an OB/GYN can expect to be sued approximately 2.3 times in his/her career.

About 3 years ago, I got the flu. Well, about 3 weeks later...I "STILL HAD THE FLU". I went to 3 docs and NONE of them would do a chest x-ray even though I was complaining of pain in the middle of my back on the left side. Well, after losing about 20 pounds and running a temp of over 104F, I finally got a chest x-ray. Sure enough, my entire left lung was filled with viral pneumonia!!!

Every one kept telling me that I had "an extended case of the flu" and to just give it time. bullshit, they didn't want to have to pay for an x-ray because they were waiting on that fat check from the HMO!!!!

That is the main reason why I opted out of med school. There was just too much shit that went on other than medicine. I became disgusted at the entire process of becoming a doctor and just decided it wasn't worth it.
 
Understandable. Same reason I don't teach. Too much red tape and bullshit. Oh yeah, and because I hate other people's kids. :D

I'm glad you mention the OB/GYN thing. Just two days ago I was thinking I should become one. I mean, even if you have to look at some ugly cracks, since I love them all so much, I feel I should keep them as healthy as possible. As a public service to the future men who will be fucking those holes.

Plus, in what other job do you get to finger 15 year olds and not get arrested. LMMFAO! I know, I'm a sick and twisted bastard.

The irony behind the entire story? Now that people can have their licenses revoked for telling doctors about their drug/alcohol use history, most people will probably keep that information from their doctor. Keeping that information from their doctor will probably result in improper diagnosises and possible drug complications. That will lead to a much greater risk of death, and thus, more preventable deaths. Those preventable deaths will probably outnumber the lives potentially saved in car accidents due to the current legislation.

In other words, Pennsylvania shot themselves in the foot!

(Side Note: Before we get on an anti-lawyer rant in this thread, lawyers are strong advocates for the medical industry keeping all patient information privileged.)

I was there two weeks ago and damn what a waste of time. Can't they hire someone that speaks English. No one could figure out what number they were calling. We all just looked at ourselves and started laughing.
 
There are two places in the world that are great for your self-esteem. Wal-mart and the DMV. Nothing but fat, ugly motherfuckers in there at all times. The only difference between the two is that no one speaks English at the DMV. Then again, depending on your definition of English, then that might hold true for wal-mart, too.
 
Well, my DMV is staffed by a bunch of fat old female hags who are miserable and they are gonna be damn sure you are miserable too!!!

It is very depressing to say the least.
 
When I needed to register my car, I was in and out of DMV in about 15 minutes. Not only that, but the woman gave me some information that will save me 20%/yr on my property taxes.
