The Donnie Keith Wall case is a disturbing example of Texas justice.

In 1992, 24th State District Court Judge W.W. Kilgore sentenced him to 35 years in prison for "aggravated possession of anabolic steroids with intent to sell".

What steroids did he have in his possession?

• 79 redi-ject Sostenon 250 (likey Organon from Mexico dosed at 250-mg per rediject)
• 100 rediject Deca Durabolin (likely Organon from Mexico dosed at 50-mg per rediject)
• "an assortment of pills"

The injectables constituted a total of less than 25 grams of actual AAS. I doubt the orals accounted for more than 5 additional grams of AAS.

The case was controversial because rather than being sentenced based on the actual amount of steroids (<30 grams), Wall was sentenced based on the total weight of the steroids and ALL fillers, excipients, carrier oils, solubilizers and bacteriostatics. So, Wall was charged with possession of 200-400 grams of anabolic steroids with intent to distribute; at the time, it was a first degree felony punishable by 5-99 years in prison.

Wall appealed the sentence arguing that the State did NOT prove that the "adulterants and dilutants, if any, were identified or added to the steroids for the purpose of increasing the bulk or quantity of the steroids".

"The defense expert believed, in short, that the non-steroid portions were carrying agents and were not added with the intent to increase the bulk. The State expert, however, disagreed. He explicitly testified that the non-steroid portions were added with the intent to increase the bulk and did not affect the steroids' chemical activity."

The appellate court sided with the State's expert witness and affirmed the judgment of the trial court:

That would mean he could be in prison until 2026!

Does anyone know what happened to Wall? Surely, he's since been released on parole or has had his sentence commuted.

That's all very depressing. Wasn't that during the time of the draconian sentencing guidelines and drug hysteria (that hasn't changed) and all the judge had to do was read down the list and check the appropriate little box? I think the federal system didn't give the judge much, if any, recourse but to follow the guidelines. My memory's fading on that one.
I don't know what the states were doing. Maybe following the feds.

20 years is what a crown prosecutor will ask for trafficking...a consumer will not get anything close to that i don't imagine or they would need to lock up half the countries police force. The reason trafficking any substance illegally gets you hammered hard is because not only are you distributing product, you are also evading taxes...same reason they got Capone

I know this is an old post but I have seen LE target "prohormones" which became illegal in 2004/2005 and are considered a controlled substance.

Ive heard that prohormones are incapabe of having any effect due to anincredibly short half life, i.e., snake oil. Yet they are illegal. Go figure.

In the Austin case, they were charging people with intent to distribute if they had more than 8 vials!!

According to court records, officials determined that the accused individuals were dealing steroids based on the number of vials of steroids that they purchased. Authorities were informed by unidentified sources that if an individual bought over 8 vials, the individual was most likely redistributing the steroids to others in order to make a profit.

You sound like you're trying to instill fear with your previous posts though by misrepresenting the facts.. Saying he was "sentenced to 20 years" and "he'll be 48 years old when he gets out of prison" is ridiculous.. At this point who knows what prison time he may get if any at all..

I think that's what that dude was trying to do wether he had is facts straight or not, fear is your best friend wether it is in a life or death situation or keeping your ass free, it can also be used to help people from making stupid decisions... That's how I look at it, I am also a paranoid mother fucker... Lol nevertheless it has helped me stay alive... You guys have a very good critical thinking skills, that's an dirrect effect or maybe inadvertently effect from this post, nevertheless to cause awareness or to influence critical thinking... Never say anything. Never consent to anything. If you are made to go in for questioning... Say nothing except I want my lawyer. People love to talk themselves into trouble. It is legal for LE to lie, & that is what they are doing with the famous "why don't you help yourself out... We already know". If they had enough evidence to convict you, they would care less whether you talked to them or not. Respectful and Silent is always your best bet.
