Actually, W.R.T. the USSC it was FDR who broke things by threatening to pack the court if they didn't say (wrongly) that the New Deal was Constitutional. FDR won, Americans lost, and the USSC became law makers practically overnight.
With Kavanaugh, instead of pulling the Nuts and Sluts gambit, the Dems could have used his position on other unconstitutional laws to discredit him, except they are laws the Dems want to use when they are in power.
According to Kavanaugh:
Patriot Act (I and II) = Constitutional.
NSA Spying = Constitutional
War On Drugs = Constitutional
And those are just the ones I noticed the day he was nominated.

The Supreme Court, they told me, was an institution to which they felt a deep allegiance, whether they agreed with its decisions or not. In their lives, and in the lives of all around me, I saw a society reluctantly but inevitably summoned to move forward not simply by the language of the Constitution but also by acceptance of the Court as an independent arbiter of the rule of law.
Critically, skeptically, but deeply, I loved that Supreme Court. Where is it? Where is the Court that claimed it was at least striving to transcend partisan politics?
That Court is gone forever. We will spend at least the rest of my lifetime fighting over its rotting corpse. No prating about civility can change that fact. The fight is upon us now, and the party that shirks it will be destroyed.
In Robert Bolt’s screenplay for Lawrence of Arabia, Prince Faisal speaks to Major T. E. Lawrence of the glories of medieval Islamic civilization: “In the Arab city of Córdoba, there were two miles of public lighting in the streets when London was a village,” he says.
But in the 20th century, Faisal sees that before him is not glory but war. “Now my father is old,” he says. “And I, I long for the vanished gardens of Córdoba. However, before the gardens must come the fighting.”
I, too, long for vanished gardens fair beyond words, for that long, eventful postwar peace in the shadow of the law and the Supreme Court that clumsily preserved it.
We did not know then that shadows were falling on that peace; we did not suspect then how fragile those institutions were; we did not imagine then how eagerly some of our fellow Americans would pull them down.

The world stands on the brink of failure when it comes to holding global warming to moderate levels, and nations will need to take “unprecedented” actions to cut their carbon emissions over the next decade, according to a landmark report by the top scientific body studying climate change.
With global emissions showing few signs of slowing and the United States — the world’s second-largest emitter of carbon dioxide — rolling back a suite of Obama-era climate measures, the prospects for meeting the most ambitious goals of the 2015 Paris agreement look increasingly slim. To avoid racing past warming of 1.5 degrees Celsius (2.7 degrees Fahrenheit) over preindustrial levels would require a “rapid and far-reaching” transformation of human civilization at a magnitude that has never happened before, the group found.

I wasn’t alone in feeling sick to my stomach Saturday with the confirmation of Brett Kavanaugh to the Supreme Court. There’s just something especially nauseating about an entitled, prep school, trust-fund baby with accusations of sexual assault being placed on the highest court in the land by another entitled, prep school, trust-fund baby with his own accusations of sexual assault.
I don’t just feel disappointed. I feel disgusted. It reminded me of the way I felt on election night, but instead of this god-awful abomination being inflicted upon us for four years, Kavanaugh could be around for 30 to 40.
Senate Republicans ignored the sexual assault allegations against Kavanaugh. They said they believe his accuser while also believing him. How can anyone believe both? Maine’s Republican Senator Susan Collins ignored everything about Kavanaugh, believing he’s something he isn’t, and gave the final vote to confirm. When Senator Al Franken was caught in a scandal for an old photo of him pretending to grope a woman, Collins called for his resignation. Yet, she’ll send Kavanaugh to the Supreme Court.
They ignored that the FBI investigation was just a cover, and a hamstrung investigation at that. They ignored that Kavanaugh lied time and time again during his hearings. They ignored that he’s a political partisan. They ignored that he contacted witnesses about an accusation before it was published, and that he lied about when he was aware of it. They ignored that he promised retribution in the future. They ignored that he may have a drinking problem and is a visibly angry person. And, if they have anything that resembles morals, principles, or a conscience, they ignored those too.
They ignored that Kavanaugh was nominated by a president who broke the law to win the election and was supported and enabled by the Russian government to gain the presidency.
They also ignored the will of the people. The majority of Americans did not support Kavanaugh. He had the lowest ratings of any SCOTUS nominee in polling history. He was confirmed with the least number of votes ever for a Supreme Court Justice. That’s OK with Kavanaugh and Republicans. They’re just fine if more disturbing details comes out about him in the future, after he’s on the bench.
Now, those people who disagree with the vote aren’t just liberals, Democrats, or people who disagree. No. Now they’re being described by Donald Trump, Mitch McConnell, and other Republicans as an “angry left-wing mob.” Tribal politics have sunk to an even lower level than where they were before.
But, if we take the Republicans description, then the majority of America is an angry mob. The majority of Americans don’t support Trump or the Republican Party. In fact, major decisions that will affect our nation for years are being decided by a minority of Americans. Those Americans are mostly the older, white Americans.

Despite having majority Senate rule, Republicans represent 143 million Americans while Democrats represent 182 million. Compound that with Trump losing the popular vote, a minority of Americans, not the majority, are deciding who gets a lifetime appointment on the Supreme Court. Basically, all the rubes stupid enough to believe in pizzagate are choosing the direction our nation’s taking for the next several decades.
That’s still not good enough for them as they had to steal a Supreme Court seat from Obama, and change the rules of how many votes are required for Trump’s nominees. I’m tired of Republicans taking what isn’t theirs and inflicting their will on the majority of Americans who don’t support them. I’m tired of us letting them do it.
I hope you’re tired too. I also hope you feel sick. Maybe you’re tired and sick enough to vote in November and send as many of these old, obtuse, tone-deaf, conservative white men out of office as possible.

1) There’s been a lot of handwringing in the media pundit corps and centrist politicians these days about the loss of comity, post-Kavanaugh. And then Donald Trump made them all look absurd with his remarks at his rally last night. Thread follows.
2) 'You don't hand matches to an arsonist and you don't give power to an angry left-wing mob, and that's what they've become. Democrats have become too extreme and too dangerous to govern. Republicans believe in the rule of law, not the rule of the mob.'
3) This is a remarkable moment in American politics: The President of the United States just declared an entire political party fundamentally illegitimate. And the media are treating it as just another of Trump’s crazy things.
4) I’m almost surprised that, after the remark about the rule of the mob, Trump didn’t then lead the crowd in a chant of “Lock her up!” That’s how brazen they have become.
5) But this is the state we are at now. One side of the political aisle, and only one, appears intent on provoking a violent civil war in America. And it is the party currently in power.

Examining records for the Trump domain, Max’s group discovered D.N.S. lookups from a pair of servers owned by Alfa Bank, one of the largest banks in Russia. Alfa Bank’s computers were looking up the address of the Trump server nearly every day.
There were dozens of lookups on some days and far fewer on others, but the total number was notable: between May and September, Alfa Bank looked up the Trump Organization’s domain more than two thousand times. “We were watching this happen in real time—it was like watching an airplane fly by,” Max said. “And we thought, Why the hell is a Russian bank communicating with a server that belongs to the Trump Organization, and at such a rate?”
Only one other entity seemed to be reaching out to the Trump Organization’s domain with any frequency: Spectrum Health, of Grand Rapids, Michigan. Spectrum Health is closely linked to the DeVos family; Richard DeVos, Jr., is the chairman of the board, and one of its hospitals is named after his mother. His wife, Betsy DeVos, was appointed Secretary of Education by Donald Trump.
Her brother, Erik Prince, is a Trump associate who has attracted the scrutiny of Robert Mueller, the special counsel investigating Trump’s ties to Russia. Mueller has been looking into Prince’s meeting, following the election, with a Russian official in the Seychelles, at which he reportedly discussed setting up a back channel between Trump and the Russian President, Vladimir Putin. (Prince maintains that the meeting was “incidental.”) In the summer of 2016, Max and the others weren’t aware of any of this. “We didn’t know who DeVos was,” Max said.
The D.N.S. records raised vexing questions. Why was the Trump Organization’s domain, set up to send mass-marketing e-mails, conducting such meagre activity? And why were computers at Alfa Bank and Spectrum Health trying to reach a server that didn’t seem to be doing anything? After analyzing the data, Max said, “We decided this was a covert communication channel.”
