Onyx Pharmaceuticals

It's significant. The government argued that the multi-billion dollar Amgen (owner of Onxy Pharmaceuticals trademark) was not only an organizational victim but that the counterfeiting was a major public health and safety issue whereas consumers didn't know the steroids were really made by an alleged heroin addict (Philip Goodwin) and not by a legitimate pharmaceutical company:

How much time he'd get if he didn't counterfeit big-pharma meds?
5 years?

Philip Goodwin, the guy that co-founded the Onyx Pharmaceuticals UGL with Tyler Bauman aka @musclehead320, pleaded guilty on November 29, 2017. As part of Goodwin's plea agreement, prosecutors will recommend an even longer prison term than recommended for Bauman. Prosecutors agreed to:

15 years / 8 months (188 months) for Goodwin

Philip Goodwin -- Sentencing set for 3/29/2018 03:00 PM in Courtroom 4 before Judge Nathaniel M. Gorton.

Elizabeth Green -- Sentencing reset for 6/14/2018 03:00 PM in Courtroom 17 before Judge Allison D. Burroughs.

Is there such a thing as good behavior time in federal prison?

He posted on instagram (or someone did for him) that with good behavior and time served he might only do 6 years.

Not worth it holy shit. Anyone caught charges purchasing?

Yep, pretty much 50% of us here at Meso have been locked up and served time for ordering gear online.

Basically, there is a 42% chance that 1 in 3 of us here will have 2 out of every 10 orders searched by LE, meaning 25% of the orders that you will place in the next 24 months will potentially result in a 5 out of 8 chance that you will spend somewhere between 60 to 80% of a 3 to 5 year sentence for possession, with a plus/minus margin of error of 2% to 4% for every 5 orders you place that total $50 or more.

Sayyyy, you haven't purchased any gear by chance, have you?

I mean caught charges purchasing from onyx because of this wrapup. Fuck your sarcasm.

One of his shippers allegedly shipped almost 4,000 packages from his own personal USPS Click-N-Ship account. The account was registered at an IP address linked to his old address and subsequent packages were shipped from an IP address linked to his current address:

Another shipper unbelievably used his REAL and CURRENT home address as the return address for illegal shipments of steroids to Onyx customers:

The feds spent a lot of time and a lot of money on this investigation including what appears to be subpoenas for multiple email accounts, ISP records, WU records, USPS records, GPS tracking, real-time surveillance, etc. I recommend reading the 50-page criminal complaint to appreciate the scope of the investigation. It is also an interesting for anyone interested in how NOT to run an illegal steroid business.

The feds have the names and addresses of almost 4000 Onyx Pharma steroid customers but I haven't seen any evidence that customers have been targeted.

Lynn Man Sentenced to Over 10 Years in Prison for Role in Counterfeit Steroid Conspiracy
BOSTON – A Lynn man was sentenced yesterday in federal court in Boston for his role in a conspiracy to traffic counterfeit steroids, including testosterone and trenbolone, to customers across the country.

Philip Goodwin, 37, was sentenced by U.S. District Court Judge Nathaniel M. Gorton to 130 months in prison and three years of supervised release. In November 2017, Goodwin pleaded guilty to one count of conspiracy to distribute controlled substances, one count of conspiracy to traffic counterfeit drugs, one count of trafficking counterfeit drugs, one count of possession with intent to distribute controlled substances, and one count of money laundering conspiracy.

In April 2017, Goodwin and five others, including Tyler Bauman, a/k/a “musclehead 320,” were arrested and charged with operating a counterfeit steroid operation on the North Shore.

From approximately May 2015 until April 12, 2017, the conspirators manufactured steroid products - made from raw materials purchased overseas - in Goodwin’s home, and marketed them as “Onyx” steroids using “Onyx” labels that were also ordered from overseas suppliers. Onyx, now owned by Amgen Inc., is a legitimate pharmaceutical company that does not manufacture steroids.

The defendants sold the steroids online to customers across the United States using email and social media platforms, collected payment through money remitters, such as Western Union and MoneyGram, and used false identifications and multiple remitter locations to pick up the proceeds. Some of the defendants laundered proceeds from the steroid sales through Wicked Tan LLC, a tanning business located in Beverly, which they owned and operated specifically to launder the proceeds of the steroid operation.

In August 2017, Bauman pleaded guilty to his role in the conspiracy and was sentenced in March 2018 to 10 years in prison.

United States Attorney Andrew E. Lelling; Michael Shea, Acting Special Agent in Charge of Homeland Security Investigations in Boston; Raymond Moss, Acting Inspector in Charge of the U.S. Postal Inspection Service; and Jeffrey Ebersole, Special Agent in Charge of the Food and Drug Administration, Office of Criminal Investigations, New York Field Office, made the announcement. Assistant U.S. Attorneys Amy Harman Burkart and David J. D’Addio of Lelling’s Cybercrime Unit prosecuted the case.

Philip Goodwin - 10 year, 10 months in prison

From court documents:

"Goodwin and Baumann Divided Responsibility, with Baumann Promoting the Organization and Handling Orders, and Goodwin Manufacturing the Steroids and Handling Inventory."

"Philip Goodwin... packaged these goods using counterfeit labels bearing the registered marks of a legitimate, global pharmaceutical company, providing his customers with indicia of quality, sterility, and safety belied by the fact that he manufactured and packaged the steroids—injectable pharmaceuticals—in his kitchen and basement, often while high on heroin.

Philip Goodwin, 37, was sentenced by U.S. District Court Judge Nathaniel M. Gorton to 130 months in prison and three years of supervised release.
In addition to counterfeiting Onyx Pharmaceuticals trademark, Goodwin's criminal history (mostly related to his drug addiction) largely contributed to the severity of his prison sentence:

"Philip Goodwin’s background and criminal record are accurately detailed in the PSR. He is 37 years old and has been a chronic drug abuser (particularly cocaine and heroin) since he was a teenager. He has two prior convictions for possession of drugs (2003 and 2005, respectively).

"During a three day period in 2005 (March 19-21), while high on drugs, Goodwin and another individual committed a spate of five armed robberies. He pled guilty and was sentenced to 2 and ½ years in state prison followed by 5 years of probation on those offenses. The only subsequent entry on his criminal history prior to his arrest on these offenses in April, 2017 was a 2010 charge for domestic assault and battery, which was subsequently dismissed."

Goodwin met @musclehead320 while they were incarcerated together at MCI-Concord in 2006. The success of the Onyx Pharmaceuticals steroid operation fueled and escalated Goodwin's repeated descent in drug addiction:

You would think that someone who’s already broken the law once and did time that they would stay low key .

You would think so. However the mind of a drug addict remembers only the ecstasy and sense of ease and comfort that comes at once upon taking that first hit. Our minds push all of the pain and despair using drugs has caused us out of our consciousness, and eventually after a time of doing well, often our minds tell us that we could handle it now, we’ve gotten more responsible, etc. That’s just the way it goes for people like us. Self-awareness doesn’t come natural to an addict.

but being an addict doesn't mean you have to continuously make mistakes and in no way does it make a viable excuse for one's actions. Personal choices are always just that, even under the influence.

Just curious, are either of you, or both of you, recovering addicts?

Yes, I am.

I had a love affair with cocaine and had an especially interesting few years with psychedelic drugs. I have been able to stay away from the later for the better part of 20 years and I haven't touched coke in a very long time as well.
