Dr. John Crisler Arrest - 'The War on Men'

So he was the golddigger in the relationship? Interesting.

That could be...but,....I think they are/were both 'Gold Diggers' and each thought the other had 'Gold'. It turned out to be a ball of lead with a chain attached to it.

When he dumped her 'cause the gold was plated, she wanted his 'hide' for not tak'n care of his "love at first sight". I suspect, there is "Gold in them thar' hills" and the good doctor ain't talk'n. Hence the 'Public Defender'. Just a Hunch.

Could be all the gold IS gone...or, it was all 'Fools Gold' (pun intended)

How narcissistic is this fool? He believes that the attorney had a "chance for greatness" and will become "famous" for defending him! Is this some sort of joke. It is laughable. If this is sincere, this is one very ill individual.

Does anyone know if he testified?

So if he doesnt win the appeal he is going to jail most likely?

No. He received a one-year suspended sentence. There were other details posted on his site. I would have thought there would have been some form of restriction not to contact the victim. In this era, this would seem to include the internet. From his rants and implied threats, this either is not the case OR he is in violation of his sentencing.

IMO, the post below is an implied threat. What does he mean by, "It's a shame we had to beep out the phone number, address, etc." Either this guy is foolish or at a dangerous tipping point.

I dont know what the syndrome is called, but we see it alot from high profile athlete's and politicians that have their ego driven behavior put them in a fallacious position of being "Above the Law". While I dont think this guy is as big as he thinks he is, It appears as tho' he believes he is 'above it all'. Whatever the syndrome is, it is usually a person's undoing.

Does anyone know the deadlines for filing an appeal? The charges - June 2011 and the conviction - October 2011 - were quick, IMO. It has been more than 6 months since the conviction. I believe the appeal has to be filed much sooner than 6 months, which might mean either there was no appeal OR it was already denied. Maybe that is why he is now trying to obtain a new trial based upon ineffective counsel.

In my State it is 30 days. It takes a sharp attorney, but it's usually a rehash of the original suit and memorandums to what was wrong with the first suit. I dont think you are allowed to enter new evidence. So it can be brought together in 30 days by a competent attorney. I think that boat has already sailed for Crisler.

How to Appeal your Felony Conviction in Michigan - Avvo.com
http://criminal.lawyers.com/Criminal-Law-Basics/Criminal-Law--Appeals-FAQs.html

: How do you prove "ineffective assistance of counsel" on appeal?
A: The Sixth Amendment to the US Constitution guarantees the right to effective assistance of counsel to every defendant in a criminal case. "Effective assistance of counsel" doesn't mean perfect counsel. A lawyer's representation of a client is "ineffective" only if it falls below an objective standard of reasonableness and prejudices (has a negative impact on) his defense.
The burden is on the defendant to establish ineffective assistance of counsel. There is a strong presumption that a lawyer's conduct falls within the wide range of reasonable professional assistance. The courts won't second-guess the attorney's tactics or strategies. That is, when deciding if an attorney's assistance was effective, a judge typically won't think to herself, "I wouldn't have done that if I was the defendant's lawyer." Rather, the courts presume or take for granted that an attorney's conduct was proper and that he gave his client adequate assistance.

It's up to the defendant to show that there's a reasonable probability that, but for the lawyer's unprofessional errors, the result of the case would have been different.

Courts realize that a person ordinarily doesn't realize his lawyer's errors and evaluate his professional performance. A person may very well not know he hasn't been competently represented until after trial or appeal, usually when he consults another lawyer about the case. So many courts will allow a person to file a claim to set aside his conviction for ineffective assistance of counsel in federal court, even if he didn't directly appeal his state conviction and sentence or file to withdraw his guilty plea.

If you've missed the filing deadlines for a motion for a new trial or to file a notice of direct appeal, you might first try to reduce the sentence under your state's laws for post-conviction relief. If that fails, and you believe there are grounds to support it, you can attempt to file what's called a "habeas corpus" petition in federal court alleging ineffective assistance of counsel.

Question - if his conviction is upheld will that have any effect on his medical license??

I believe you are right. From what I have read, the time for an appeal is far past - http://coa.courts.mi.gov/rules/documents/1Chapter7AppellateRules.pdf .

Also, if you are trying for ineffective counsel, it pays to have the cooperation or assistance from your trial attorney. That will go a long way to be granting a new trial. In this case, Crisler has done nothing to ingratiate himself with his attorney of record.

As far as the license, I think nothing since it is a misdemeanor. Another conviction will result in a felony. I am wondering if he has violated any probation rules.

He says he has a "Ginther" hearing tomorrow (the 21st)

An evidentiary hearing to determine whether the factual basis existed to support a claim of ineffective assistance of counsel is called a Ginther hearing in Michigan.

In People v. Ginther, 390 Mich. 436 (1973), the Michigan Supreme Court held that:
A defendant who wishes to advance claims that depend on matters not of record can properly be required to seek at the trial court level an evidentiary hearing for the purpose of establishing his claims with evidence as a precondition to invoking the processes of the appellate
courts except in the rare case where the record manifestly shows that judge would refuse a hearing; in such a case the defendant should seek on appeal, not a reversal of his conviction, but an order directing the trial court to conduct the needed hearing

My best guess..... Crazy Ass White Boy - CAWB.
If so, yet another veiled threat.

That would be crazy. IF true, it would appear to be another veiled threat. IF true, one more piece of evidence he is losing it - tipping over. If he loses the Ginther hearing, what next?

Maybe: "Candy-Assed White Boy"

More "cawbs" clues.

According to Bulldog, Super Moderator(not just Moderator mind you)," he misses that dude (cawbs)."

On further review, Katzenajmmer ended some of his posts - cawbs.

I do hope he/it comes to light because I'm very curious now.

Nothing like a good mystery.
